Services Provided

Mr. Horowitt serves as a neutral in mediation, arbitration, early neutral evaluation, med-arb and mini-trials as well as a special master and discovery referee.

Experience

Mr.Horowitt was admitted to practice in 1981. Prior to forming Coleman & Horowitt, LLP, he was a partner of the Fresno, California firm of Lerrigo, Nibler, Berryman, Coleman & Bennett. Prior to moving to Fresno, Mr. Horowitt was engaged in private practice in Orange County, California.

He has conducted all phases of litigation in the areas of banking, business disputes, securities fraud (class action and individual), construction, real estate, environmental, casualty insurance defense, personal injury and commercial collections, from initial client contact to settlement, mediation, arbitration, and trial - court and jury (in State and Federal Court) and administrative proceedings (before the United States Environmental Protection Agency, Department of Agriculture, National Labor Relations Board, California Department of Fair Housing and Employment, Worker's Compensation Appeals Board, and Agricultural Labor Relations Board). He has also assisted in transactions, including incorporation, purchase and sale agreements, secured and unsecured transactions, and employment contracts.

Mr. Horowitt has served as an arbitrator (for the American Arbitration Association, FINRA Dispute Resolution, the Better Business Bureau Dispute Resolution Center, and the Fresno and Madera County Superior Courts), mediator (Fresno, Kings, Madera and Merced County Courts, privately and for the Better Business Bureau Dispute Resolution Center), early neutral evaluator (United States District Court, Eastern District of California), special master (for Judge James Ware, United States District Court, Northern District of California), discovery referee and judge pro tem (Fresno and Merced County Courts). he is also a member of the Southern California Mediation Association.

Mr. Horowitt is a member of the Litigation Section of the California Lawyers Association (formerly California State Bar), the Fresno County Bar Association (member and former chair of the Construction Law Committee), the Association of Business Trial Lawyers (Past President and Board Member, San Joaquin Valley chapter), the American Bar Association (member: Litigation and Law Office Economics Sections as well as the ADR, Construction, and Commercial Law and Banking Committees of the Litigation Section), the California Creditor Bar Association, and the Southern California Mediation Association

Publications and Lectures

Mr. Horowitt is the author of numerous articles and has served as a panelist for the Association of Business Trial Lawyers, Consumer Attorneys of California, AGC of California, National Business Institute (NBI), International Society of Primerus Law Firms, National Association of Women in Construction, and CPA/Law Forum.

Honors and Awards

Mr. Horowitt has been named a top 100 Northern California Super Lawyer® in 2015 through 2019, as well as a Super Lawyer® (2007 [construction law], 2007-2019 [business litigation]); has received an AV®-Preeminent rating from Martindale Hubbell, and a10.0 rating from Avvo. He was Named one of the top 100 litigators by American Society of Legal Advocates (2013-2016), a Fellow: Trial Lawyer Honorary Society (Litigation Counsel of America) and a Premier 100 Trial Lawyer (American Academy of trial Lawyers). He is also the 1993 recipient of the California State Bar Association’s President’s Pro Bono Service Award (District 5), as well as several commendations from the State Bar for providing pro bono legal services. Admissions

Mr. Horowitt is licensed to practice in all of the courts of the state of California, the United States Supreme Court, the United States Court of Appeals, 9th Circuit, and all districts of the United States District Court in the state of California.

 

He has also practiced (pro hac vice) in the United States District Court, Eastern District of Arkansas, Western Division (Little Rock) United States District Court, District of Nevada (Las Vegas) and Maricopa County, State of Arizona.

Training

Mr. Horowitt has received “Basic” and “Advanced” Arbitrator Training from the American Arbitration Assn. and Panel Member and Chairperson Training -Securities Arbitrator from FINRA Dispute Resolution.

 

He has also received “Mediation skills training” from the Dispute Settlement Center of Central California and San Joaquin College of Law, and additional CLE in mediation and arbitration training.

$5,000 - Full day (includes review of materials and pre-mediation calls with counsel)
